So President Obama has made his second nomination to the Supreme Court. And, while I'm sure Elena Kagan is a very competent legal scholar, she doesn't seem to have excited people all that much. Certainly not as much as Sonia Sotomayor did last year. I think there are a couple of reasons for this.
1. Obama said he was looking for someone who could relate to everyday people and understood how the law impacted the lives of everyday people.
2. Just a week or so ago, Obama was speaking at a commencement ceremony where he called on graduates to "seek diversity of thought."
So, he nominated a woman from a wealthy NYC family who has spent her entire career either in academia or working for democratic administrations. She doesn't seem all "everyday people" to me. Nor do I think she represents all much "diversity of thought" on Obama's part.
Upon her confirmation (and we all know she'll be confirmed) we will have a Supreme Court made up of only Ivy League Law School grads. Five from Harvard, three from Yale and one from Columbia. Also, five of the nine members of the court will be from the NY/NJ metro area. Also, the court will be Protestant-free. There will be six Catholics and three Jews. That's not really all that diverse either.
Also, have you noticed that there has been this rather strange reaction from the liberals to Kagan's nomination? They've been bemoaning the fact that they don't think she's really a liberal. And they're saying that there all these questions about her. I'm no conspiracy theorist, but it all looks pretty orchestrated to me. As if the White House really wanted there to be criticism from the left so they could make the rather lame claims that "The President is standing up to his base!" and "Well, if both the far right and far left are complaining, she must be awesome!"
Personally, I suspect she's very, VERY liberal. I mean super-duper liberal. So freaking liberal most people would faint if they realized it. And that's the reasoning behind the whole fake "criticism from the left" thing.
Of course, unlike all the other people in the blogosphere who never went to law school, I make no claims to being a legal or constitutional scholar. Even though I have watched a lot of "LA Law" "The Practice" and "Law and Order" over the years. But, I admit that I'm no expert on these things. It's entirely possible that Ms. Kagan will be a great Supreme Court justice. I'm just predicting that she will generally defer to the government on most matters of both regulation and civil rights. If it turns out that I'm wrong, I will be more than happy to admit it.
And best part of that is, if she does turn out to be a bad pick, we can fix it in 30 or 40 years when she retires.

Kind of on the same general subject here, I was flipping through the channels the other night and happened upon MSNBC. Normally I don't stop on that channel but something caught my eye. It was supposed to be Rachel Maddow, but she had some tragically hip dude guest hosting for her.
Anyway, he had a guest on and they were discussing the oil leak down in the Gulf. The guest was explaining what BP's current efforts are to stop the leak. The host was sitting there making these faces and scoffing at the ideas the guest was explaining.
This is what I really hate about MSNBC. Here you have some liberal hipster, sitting there in his Brooks Brothers suit and his expensive designer glasses just throwing spitballs at everyone and everything without ever coming up with any ideas or solutions of his own. Sure, the ideas that BP is trying seem a bit far-fetched, but does anyone really think they don't want to stop the leak? (Yes, I know that Fox News has claimed more than once that Obama didn't want to stop the leak for some crazy-ass reason, but nobody does loony conspiracy theories like those morons)
Anyway, that's basically you ever get from MSNBC. Arrogant liberal hipsters pumping out smug almost as fast as that leak is pumping out oil.
